It is ilegal to copy, reproduce, or alter these photographs elsewhere without Photographer’s permission, and violators of this Federal Law will be subject to its civil and criminal penalties. This Contract incorporates the entire understanding of the parties and is governed by the laws of New York, New York. Any modifications of this Contract must be in writing and signed by both parties.
Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business. If Justine Knight Photography cannot perform this Agreement due to fire, theft or other casualty, or other cause beyond the control of the parties, or due to Photographer’s illness or emergency, then the Photographer shall have no further liability with respect to the Contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event that Justine Knight Photography fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of all monies paid.
The Photographer retains the right of discretion in selecting the photographic materials released to the Client. The Client shall not receive any photographic materials not presented to the Client. The Photographer also retains the right to make adjustments to the photographs in post-processing as the Photographer deems within their creative control. Additional processing such as certain highly customized requests (such as "head swaps") may be requested by the Client for $35 per file.
Capture and Delivery
The Photographer is not liable to deliver every image taken at the event. The determination of images delivered to the Client is left to the discretion of the Photographer.
All photographic materials, including but not limited to negatives, transparencies, proofs, and previews, shall be the exclusive property of the Photographer. All orders must be placed within the outlined schedules within this Contract. No products, including digital files, will be released until the agreed upon amount is paid in full per the payment schedule outlined in this Contract.
The Photographer shall make gallery proofs available through an online gallery proofing website. These proofs shall be available to the Client within two weeks of the photographic event. If an online proofing gallery is delivered, it shall remain open for 9 months from delivery.
